JUSTICE BIRENDRA KUMAR ORAL ORDER 26-11-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 315 and 504/34 of the Indian Penal Code.
Allegation against the petitioners is that they have committed assault against the wife of the informant who was carrying a child, since last eight months, in her womb. The injury report, available with the case diary, reveals that a dead child was born due to heavy bleeding as a result of the injury caused by the petitioners.
Submissions of the parties are that they have entered into a compromise.
Patna High Court Cr.Misc. No.33537 of 2016 (3) dt.26-11-2016 2/2 Considering the nature of allegation against the petitioners, I am not inclined to enlarge them on anticipatory bail in connection with Vijaipur Police Station Case No. 47 of 2016 @ Bijaipur Police Station Case No. 47 of 2016 pending in the court of learned Additional Chief Judicial Magistrate-IV, Gopalganj/Successor Court.
Hence, prayer for bail is refused.
