JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-12-2020 Heard Mr. Manoj Kumar, learned counsel for the petitioner and Mr. Ganesh Prasad Singh, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Nayagaon P.S. Case No. 1 of 2020 registered for the offence under Section 302 / 379 / 120 (B) / 34 of the I.P.C. and Section 27 of the Arms Act.

The allegation as per the First Information Report is that the petitioner along with other accused persons arrived at the door of the informant and the co- accused Diwakar Paswan told that his father - Praveen Paswan has invited the brother of the informant for eating fish on which the informant's brother accompanied the accused persons and in the evening the dead body of the informant's brother riddled with bullets was found

Patna High Court CR. MISC. No.26564 of 2020(4) dt.04-12-2020 2/3 near the house of Praveen Paswan i.e. the father of the coaccused/ Diwakar Paswan. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to village politics. Learned counsel further submits that from perusal of the First Information Report it would be evident that it was the co -accused: Diwakar Paswan who had invited the brother of the informant for fish party and dead body of the victim was found near the house of Praveen Paswan i.e. the father of the coaccused/ Diwakar Paswan. On the other hand, learned counsel for the state referring to the case diary submits that witnesses have said that petitioner along with other accused persons were seen firing in the air and fleeing away from the place where the dead body was found and the petitioner in conspiracy with others have committed the present offence.

Having heard learned counsel for the parties and taking into consideration the materials available on record , I am inclined to grant regular bail to the petitioner upon completion of one year in custody.

Accordingly, let the petitioner, above named, be

No.26564 of 2020(4) dt.04-12-2020 3/3 released on regular bail upon completion of one year in custody on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ravi Ranjan, learned Judicial Magistrate 1st Class, Begusarai / court concerned in connection with Nayagaon P.S. Case No. 1 of 2020.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
