JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 32(i),(ii), 36, 41(1) of the Excise Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 23.02.2022, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is recovery of 2700 litre of liquor from a truck.

The learned counsel for the petitioner submits that the petitioner was not arrested from the spot and came to be implicated based on confessional statement of co-accused

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and was not arrested from the spot and petitioner is neither the owner, nor the driver of the truck, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kanti P. S. Case No.98 of 2022. The application stands allowed.
