The petitioner seeks bail in connection with POCSO Case No. 38 of 2019 arising out of Sheikhpura (Mahila) P.S. Case No.40 of 2019 registered for the offences punishable under Section 376(G) of the Indian Penal Code and Section 67 of I.T. Act.

By order dated 04.01.2021, a status report regarding stage of trial has been called for from the court below in connection with POCSO Case No.38 of 2019 arising out of Sheikhpura (Mahila) P.S. Case No.40 of 2019. The report is at flag 'B'.

It is stated that VIth Additional District and Sessions Judge, Sheikhpura had mentioned that three witnesses out of six

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, I am not inclined to enlarge the above named petitioner on regular bail. Accordingly, the prayer for regular bail of the above named petitioner in connection with POCSO Case No.38 of 2019 arising out of Sheikhpura (Mahila) P.S. Case No.40 of 2019 pending in the court of learned 1st Additional District and Sessions Judge, Sheikhpura is hereby rejected. However, the trial court is directed to conclude the trial within six months. If the trial is not concluded within the stipulated period, the petitioner may renew his prayer for bail.
