Mr. Shyam Bihari Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 18-04-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Pawana P.S. Case no. 5 of 2019, registered under Sections 341, 323, 506 and 307/34 of the Indian Penal Code.

Co-accused Shailesh Singh is said to have assaulted on the head of the informant by means of sharp edged weapon. Informant also sustained injury on the right hand finger during the course of interfering the assault. Earlier to the occurrence, petitioners along with some other miscreants had extended threatening of dire consequence to the informant.

Patna High Court CR. MISC. No.25089 of 2019(2) dt.18-04-2019 2/2 It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. They do not happen to be assailant. The allegation of extending threatening to the informant levelled against the petitioners is vague and no date of the aforesaid occurrence has been given in the written report. Aforesaid allegation is not specific rather general and omnibus. Petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bhojpur at Ara in connection with Pawana P.S. Case No. 05 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
