The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code and Section 27 of Arms Act. As per allegation in the F.I.R, two unknown miscreants on the point of pistol, snatched away mobile, some documents and Rs. 4500/- from the informant when the informant was returning from Kursela to Naugachia. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on suspicion. The petitioner is not named in FIR. It is further submitted that
Patna High Court CR. MISC. No.27777 of 2023(3) dt.24-07-2023 2/2 though the stolen articles have been recovered from the possession of the petitioner but the same has not been put on TIP. So far as the recovery of country made pistol is concern, the same is planted one by the police officials to make the case grievous. Moreover, he is languishing in judicial custody since 24.09.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kursela P.S. Case No. 184 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist, Katihar.
