The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 20(b)/22 of the N.D.P.S. Act.

The prosecution case as lodged by the police personnel is that on 05.02.2019 at 8 P.M. on secret information that Ganja is being cultivated and used for sale in the house of Rampukar Singh of village Gopalpur, he reached at the house of Rampukar Singh then he saw that four persons are fleeing away and out of whom one person was caught and asked about the other persons who succeeded to flee away. The apprehended person disclosed the name of Rampukar Singh, son of Santan Singh, Abhisek Sharma, son of Santan Singh (petitioner) and

Patna High Court CR. MISC. No.32112 of 2019(4) dt.22-08-2019 2/2 Prem Ranjan, son of Rampukar Singh.

It has been submitted on behalf of the petitioner that quantity of 3.700kg of Ganja was recovered from the possession of the co-accused. It is further submitted that there is no specific allegation against the petitioner.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, N.D.P.S. Act, Gaya in connection with Sherghati Police Station Case No. 43 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
