Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Barahara (Krishnagarh O.P.) P.S. Case No.741 of 2022 dated 24.10.2022 arising out of N.D.P.S. Case No.01 of 2023 registered for the offence(s) punishable under Section(s) 20(b) (ii)(B) of the N.D.P.S. Act..

The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to the recovery of 1.162 kg of narcotic material suspected to be Ganja which is alleged to have been recovered from the possession of this petitioner and the said contraband is slightly more than small quantity and petitioner has fair and
Patna High Court CR. MISC. No.25406 of 2023(2) dt.23-05-2023 2/2 clean antecedent and has been languishing in jail since 25.10.2022 and against him the investigation has been completed, in fact the petitioner is quite innocent and he has been falsely roped in this case.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the quantity of alleged contraband and the custody period of this petitioner as well as the completion of investigation against him, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail in connection with Barahara (Krishnagarh O.P.) P.S. Case No.741 of 2022 arising out of N.D.P.S. Case No.01 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) sangam/- U T
