CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 10-09-2020 Heard learned counsel for the petitioner and learned counsel for the respondent.

Petitioner seeks bail in a case registered for the offence punishable under Sections 341, 307/34 of Indian Penal Code.

Informant has alleged that on 03.03.2020 at about 2:20 O' clock when he was going to his house from Sonebarsa Block in the way petitioner and one Bindeshwar Ram caught hold his arm and petitioner gave knife blow in his left hand and left side of abdomen and thereafter both succeeded in fleeing away.

It has been submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this

The date of occurrence is of 03.03.2020 but the written report was submitted by the informant on 25.03.2020 after delay of 22 days without any valid explanation. Petitioner is a Government Teacher having no criminal antecedent and is in custody since 19.04.2020.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Kanhauli P.S. Case No. 40 of 2020 with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (S. Kumar, J) Rajiv/- U T
