These applications, for grant of anticipatory bail,
Patna High Court Cr.Misc. No.32420 of 2017(3) dt.11-08-2017 2/3 arises out of C. R. Case No. 131 of 2016, disclosing offence under Section 498A/327/379 of the Indian Penal Code. The petitioner, in Criminal Misc. No. 32420 of 2017, is the husband of complainant-Opposite Party No. 2; whereas, petitioners of Criminal Misc. No. 20035 of 2017, are father-in-law, mother-in-law, brother-in-law and married sister-in-law of the complainant- pposite Party No. 2.
Learned Counsel for the petitioner submits that the petitioner-husband is ready to keep the Opposite Party No. 2 with full love and dignity.
There is no reason for this Court to feel that if granted anticipatory bail, the petitioners shall flee from the course of trial.
Considering the nature of accusation and submission advanced on behalf of the petitioners, these applications are allowed.
Let the petitioners, namely, Prabhat Kumar Singh @ Prabhat Kumar, Abadh Kishore Singh @ Noonu Babu, Sunaina Devi, Raushan Kumar and Minu Devi, in the event of their arrest or surrender before the Court below within a period of six weeks from today, be released on bail on furnishing bail bonds
Patna High Court Cr.Misc. No.32420 of 2017(3) dt.11-08-2017 3/3 of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Benipatti, Madhubani, in connection with C. R. Case No. 131 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure, 1973.
This is subject to the condition that the petitioners shall present themselves before the Court, as and when required and in the event of failure on their part to appear before the Court below on two consecutive occasions, their bail bonds shall be liable to be cancelled.
