In the present case petitioner is claiming compassionate appointment as his father has died on 6.3.2005 in harness. Claim has been made that his father was the sole bread earner so he should be given the benefit of compassionate appointment.

From the pleading of this writ petition it appears that mother of the petitioner had applied for her compassionate appointment and later on recommended the name of her elder daughter. But changed the mind, recommended for

Patna High Court CWJC No.14724 of 2013 (3) dt.09-12-2016 compassionate appointment of petitioner.

Learned counsel for the State has drawn the attention of this Court towards Annexure 3 which shows that candidature of Guria Kumari sister of the petitioner was not processed rather returned, directed to make request for the application for companionate appointment of petitioner, ultimate result does not reflect from the writ petition. In such view of the matter, concerned respondent is directed to process the application of the petitioner and take decision one way or other in accordance with law. For convenience, petitioner is directed to file a detailed representation before the Regional Director, Animal Resource Department, Bhagalpur Zone, Bhagalpur who will place the case of the petitioner before the Compassionate Appointment Committee and Committee will take decision in accordance with law.

With the aforesaid observation and direction this writ petition is disposed of.
