====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Neemchak Bathani P. S. Case No. 43/2021 in a case registered for the offences punishable under Sections 147, 341, 342, 323, 324, 307, 379, 504 of the Indian Penal Code.

3. As per the prosecution case, all the F.I.R. named accused persons including this petitioner assaulted informant by means of lathi, danda and snatched his mobile phone, gold chain and some cash.

4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus. Doctor has found injury sustained by the informant to be simple in nature.

Patna High Court CR. MISC. No.25900 of 2025(2) dt.27-06-2025 2/2 Petitioner claims clean antecedent. Petitioner is in custody since 14.12.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering simple injury, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateX, Gaya in connection with Neemchak Bathani P. S. Case No. 43/2021.
