Petitioner apprehends arrest in connection with Shahpur P.S. Case No.173 of 2016 registered for the offences under Sections 406, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
The complainant has alleged that he entered into an agreement with the accused persons through this petitioner for purchasing land at the rate of Rs.5,75,000/- per katha. As per agreement, the complainant paid Rs.12 lacs to the land owner (accused) and the remaining amount was to be paid at the time of execution of sale deed. This petitioner allegedly introduced the land owner with the complainant.
Patna High Court Cr.Misc. No.7667 of 2018 (3) dt.28-02-2018 It has been submitted that the petitioner had simply introduced the complainant with the land owner. Except this, there is nothing against the petitioner. The allegation of committing fraud and forgery is against other co-accused persons.
The learned A.P.P. opposed the submission.
Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioner, in the event of arrest or surrender before the learned court below within six weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the likewise amount each to the satisfaction of learned A.C.J.M.-I, Danapur, Patna in connection with Shahpur P.S. Case No.173 of 2016, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
