The petitioner attained superannuation on 31.05.1996. He has filed the writ petition originally with a prayer to give due promotion to him and arrears of pay, however, he has later on filed an I.A. seeking an amendment in the writ petition wherein, he wants to implead certain persons as parties/respondents to the writ petition and further wants the State authorities to redetermine and re-draw the date of year of Junior Selection Grade/Senior Selection Grade promotion granted belatedly to him and further to grant Super Time Scale Grade to him based on a notification issued on 04.08.1990, stipulating allocation of 35% of posts under every cadre of the sanctioned strength for the purpose of Super Time Selection Grade.
Patna High Court CWJC No.21677 of 2013(2) dt.06-02-2023 2/2 All the aforesaid prayers had been made in 2013 and vide amendment on 21.10. 2019 i.e. after a period of almost 25 years, no plausible explanation has come forward on behalf of the petitioner for not having claimed benefits as allegedly payable to him within time.
In the opinion of this Court, the claim raised by this petitioner is very stale and old.
In the main writ petition, this Court notices that he was claiming regularization from 01.04.1981 instead of 28.10.1990 when he has been regularized. The order of regularization from an earlier date has also not been challenged and the concerned date.
Keeping in view the above, this writ petition is found fit to be suffering from gross latches and delay and is accordingly dismissed.
The I.A. also stands dismissed.
