Petitioner seeks bail in a case registered for the offences punishable under Sections 307, 397, 427 of the Indian Penal Code and Section 27 of the Arms Act.

The FIR of the occurrence of dacoity is against unknown.

Submission is that petitioner is in custody since 08.08.2018. Investigation of the case is already complete. Petitioner was never put on Test Identification Parade during investigation nor any incriminating article was recovered from possession of the petitioner. Though, the petitioner has got list

Learned counsel for the Bank opposed the prayer for bail.

Considering the fact that there is no substantial material against the petitioner save and except criminal antecedents, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Birpur Police Station Case No. 11 of 2018, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/Banti U T
