The petitioner apprehends his arrest in connection with Araria P.S. Case no. 656 of 2016, registered under Section 379 and 411 of the Indian Penal Code.
The accusation is that informant parked his motorcycle in front of the Doctor's clinic and entered in the clinic. When he came out from the clinic, he did not find his vehicle parked there. On video clippings, the informant came to know that his motorcycle was theft by one Soyeb. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R, rather, the name of the petitioner has been disclosed by co-accused Soyeb, who was
Patna High Court Cr.Misc. No.13135 of 2018(3) dt.18-04-2018 2/2 identified in the video clipping, except that there was nothing against the petitioner. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 656 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
