Petitioner apprehends arrest in connection with Buxar (Muffasil) P.S. Case No. 213 of 2018 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely because of previous rivalry and also the fact that he happens to be the cousin of co-accused Ganesh Yadav. For the same occurrence, Buxar (Muffasil) P.S. Case No. 212 of 2018 (Annexure-2) was also registered in which the present informant and one other person were arrested with arms
Patna High Court CR. MISC. No.25359 of 2019(2) dt.19-04-2019 2/2 and ammunition from the place of occurrence. The allegations are general and omnibus of firing against all the accused persons and petitioner was only a member of the mob.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (Muffasil) P.S. Case No. 213 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
