(ii) For holding tht the respondent authority is not entitled for a direction to the petitioner to put into a fresh empanelment, it is against the order of this Hon'ble Court as well as petitioner is already empanelled with the aforesaid Bihar Textbook Committee and security money has been already deposited, therefore, it is not necessary again for making empanelment as well as three years of blacklisting is already going to be expired in the month of August 2022.

(iii) For any other relief/ relief to which the petitioner may be found entitled to in the eye of law."

After the matter was heard for some time, finding the Court not in favour of the submissions made by the learned counsel for the petitioner, learned counsel for the petitioner, under instructions, states that the petitioner shall be content if the petitioner is permitted to withdraw the present petition, with liberty to initiate appropriate proceedings before the appropriate forum and to take recourse to such other alternate remedies which are equally efficacious in law, including permitting the petitioner to file a fresh petition on a subsequent cause of action.
