The petitioners seek anticipatory bail in a case instituted for the offences under Sections 304 B and 201/34 of the Indian Penal Code.
Petitioners are cousin mother-in-law and father-in-law of the victim. The victim was burnt to death by sprinkling Kerosene Oil by husband and for that father of the deceased has made statement before the Officer Incharge of Pirbahore police station at PMCH where he has stated that husband poured Kerosene Oil upon the victim and lit fire. She succumbed to the injuries whereafter another First Information
Patna High Court Cr.Misc. No.20513 of 2017 (3) dt.06-07-2017 Report was lodged after 15 days wherein petitioners were also roped in the case in the matter of demand of dowry. Learned counsel for the petitioners submits that petitioners are living in the State of Maharastra having no relationship with the husband of the victim and only to harass the entire family members they have been made accused. On perusal of the record it appears that petitioners are residing in the State of Maharastra.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Parmila Devi @ Shila Devi and Ramesh Giri alias Rameshwar Giri, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- XIth, Siwan in connection with Duraunda P.S. Case No. 68 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
