This application, for grant of anticipatory bail, arises out of Maharajganj Police Station Case No. 157 of 2018, disclosing offences under Sections 304B/201/34 of the Indian Penal Code.
The petitioner is the uncle of the husband of the deceased.
Learned Counsel for the petitioner has submitted that there is general and omnibus allegation of demand of dowry against all the persons named in the First Information Report. He has submitted that the petitioner has been implicated only because he is related to the husband of the deceased and over
Patna High Court CR. MISC. No.23457 of 2019(2) dt.11-04-2019 2/2 and above the same, there is no material against him. Considering the above submission, this application is allowed.
Let the petitioner, Ramesh Prasad, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Maharajganj Police Station Case No. 157 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
