JUSTICE ARVIND SRIVASTAVA ORAL ORDER 17-02-2018 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Muffasil P.S. Case No. 225 of 2017 registered for the offence punishable under sections 25(1-A), 25(1-AA), 25(1-b)A, 25(1-AC) 26 (I) (ii)/ 35 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to previous enmity. Parties are neighbours and there is admitted old land dispute between them. Petitioner has been implicated in this case on confessional statement of co-accused. Nothing has been recovered from this petitioner. Petitioner has clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,

Patna High Court Cr.Misc. No.8214 of 2018(2) dt.17-02-2018 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 225 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
