This application for anticipatory bail arises out of Complaint Case No. 98 of 2019 registered for the offence punishable under Sections 379 and 420 of the Indian Penal Code.

It is the prosecution's case that on 18.01.2019, the petitioner had gone to the complainant's shop and purchased spices worth Rs. 1,90,175/-. Without making payment, he left the shop.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.22429 of 2020(2) dt.02-11-2020 2/2 has submitted that there is absolutely no paper to suggest that any item was purchased by the petitioner from the complainant. It has also been argued that because of some dispute in relation to business transaction, the Complaint Case has been lodged. Be that as it may, considering the nature of controversy, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-I, Patna City in Complaint Case No. 98 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
