2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 149, 341 , 323 , 325 , 307, 448 and 380 of the Indian Penal Code . 3 . As per the prosecution case , petitioner No. 3
Patna High Court CR. MISC. No.29461 of 2024(4) dt.23-07-2024 2/3 (Devewndra) and co-accused Manish Paswan assaulted on the eye of the Atul Jha by means of iron rod and petitioner No. 1 , 2 and 4 assaulted on the head of the Birendra Kumar Ojha due to which they sustained injury .
4. Learned counsel for the petitioners submits that due to pending land dispute between the parties, a simple altercation took place between them. The present case has been lodged only with a view to make pressure upon the petitioners to compromise the T.S case No. 457 of 2021 , which is pending in Civil Court Bhojpur at Ara . Injury allegedly caused by these petitioners are found to be simple in nature .
5. Learned counsel for the State oppose the bail petition.
6 Considering the backdrop of the incident and nature of injury caused by these petitioners and other circumstances of the case in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Bhojpur Ara in connection with Udwant Nagar P.S. Case No. 521 of 2023 , subject to the conditions laid down under section 438(2) of the
Patna High Court CR. MISC. No.29461 of 2024(4) dt.23-07-2024 3/3 Code of Criminal Procedure .
