The petitioner seeks bail in anticipation of his arrest in connection with Rampur P.S. Case No. 373 of 2019 instituted for the offences under Sections 341, 323, 325, 307, 379, 504 and 34 of the Indian Penal Code. Though the petitioner also has been alleged to have taken part in the assault, but nothing specific has been attributed against him.

The other accused persons, with specific accusation against them, have been granted anticipatory bail by different Benches of this Court vide orders dated 14.10.2020

Patna High Court CR. MISC. No.34944 of 2021(2) dt.20-01-2022 2/2 and 12.02.2021 passed in Cr. Misc. Nos. 25887 of 2020 and 28028 of 2020 respectively.

The learned counsel for the petitioner has submitted that because of the background enmity, such a case has been lodged arraigning petitioner also as one of the accused persons.

Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 373 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
