JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 06-07-2017 The petitioner apprehends his arrest in a case under section 498A of the Indian Penal Code.
It is alleged by the informant that the petitioner assaulted her due to non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife with due care, love and affection.
Considering the facts and circumstances of the case, the matter is disposed of in the following terms: i) If the wife of the petitioner appears in the Court below within six weeks from today and submits to live with the petitioner, the petitioner would be released on bail in connection
Patna High Court Cr.Misc. No.18091 of 2017 (3) dt.06-07-2017 with Khagaria (Mahila) P.S. Case No.5 of 2017 on furnishing bail bond of Rs.5000/- with two sureties of the like amount each to the satisfaction of the Court below.
ii) In case the wife of the petitioner is not willing to live with the petitioner, the learned Magistrate or the Court in seisin of the case would dispose of the bail petition of the petitioner on its own merit.
In the meanwhile, no coercive steps would be taken against the petitioner, namely, Sharad Kumar, for six weeks from today, in connection with Khagaria (Mahila) P.S. Case No.5 of 2017 pending in the Court of S.D.J.M., Khagaria.
