JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-09-2023 The present writ petition has been filed seeking the following relief:- "1. That by this writ application the petitioner craves indulgence of this Hon'ble High Court for issuance of an appropriate writ or writs, direction оr directions commanding the respondents to consider and modify the order of the A.C.P. and grant the pay-scale of the petitioner in the light of the decision taken by the State Government and modify the earlier pay-scale, in pursuance to the report of the Fitment
Patna High Court CWJC No.18037 of 2015(2) dt.21-09-2023 2/3 Committee, which has been accepted and implemented by the Finance Department and the authority grant the said pay-scale of Rs.5500-9000/- in 1st Assured Career Progression and Rs.650010500/- in 2nd Assured Career Progression with effect from 09.8.1999 to the similarly situated employee namely Shri Shailendra Kumar Varma, retired Assistant Dealer and Shri Vidyanand Yadav, retired Assistant Dealer."

At the outset, the learned counsel for the petitioner submits that though the petitioner has been granted the benefits of first and second A.C.P. as also M.A.C.P. but the pay-scale have not been revised, hence he be granted liberty to approach the Chief Engineer, Minor Water Resources Department, New Secretariat Building, Bailey Road, Patna i.e. the respondent no. 2 for redressal of his grievances. Liberty, so sought, is granted. 3.
It is needless to state that in case the petitioner approaches the respondent no. 2 by filing appropriate representation, within a period of
Patna High Court CWJC No.18037 of 2015(2) dt.21-09-2023 3/3 four weeks from today, the same shall be disposed off by the respondent no. 2, by passing a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter.

The writ petition stands disposed off.
