JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-01-2022 Heard Mr. Abhay Kumar Singh, learned counsel for the petitioner and Mr. Mohammad Sufyan, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Ara Mufassil PS Case No. 346/2020 registered for the offence punishable under Sections 25(1-b)a/26/35 of the Arms Act. As per First Information Report, the police raided the house of one Sujit Kumar Yadav and recovered one country made pistol along with one live cartridge from the possession of the petitioner.
Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and while he was sleeping in the house of co-accused, Sujit Kumar Yadav from whose possession also illegal fire arm was
Patna High Court CR. MISC. No.35158 of 2021(2) dt.04-01-2022 2/2 recovered and the petitioner has been implicated in the present case due to political rivalry. He further submits that the petitioner is in custody since 24.10.2020 and the charge-sheet has already been submitted.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 24.10.2020 and the charge-sheet has already been submitted, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, THAKUR YADAV be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bhojpur, Ara in connection with Ara Mufassil PS Case No. 346/2020.
