JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 06-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Bakhari P.S. Case No. 20 of 2017 registered for the offences punishable under Sections 447, 341, 323, 324, 384, 379, 307 of the Indian Penal Code, later on, Section 302 of the Indian Penal Code was added in the FIR.

No.21661 of 2017 (2) dt.06-07-2017 2 / 2 Regard being had to the gravity of the offence in which several persons sustained injuries and one person died, I am not inclined to grant pre-arrest bail to the petitioners though some of them were only member of an unlawful assembly. Accordingly, their prayer for anticipatory bail is rejected. In case, they surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
