JUSTICE RAVI RANJAN ORAL ORDER 15-09-2016 After some argument, learned counsel for the petitioners seeks leave to withdraw this application so far it concerns the petitioner no. 1, Dilip Pandey to surrender and seek regular bail before the court below.

Accordingly, this application stands dismissed as withdrawn as against the petitioner no.1, Dilip Pandey with the aforesaid liberty.

The petitioner no.2 apprehends his arrest in a case registered for offences punishable under Sections 341, 323, 307, 302 and 34 of the Indian Penal Code.

So far the petitioner no.2 is concerned, it is contended that only allegation upon him is to have assaulted by fists and

No.34359 of 2016 (2) dt.15-09-2016 2 / 2 slaps and, in fact, the allegation of assault on the chest and the head upon the informant's husband is upon co-accused Dilip Pandey. It is urged that both the sides are agnates. Having regard to the facts and circumstances of the case, let the petitioner no.2, namely, Sudhir Pandey be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Laxmipur P.S. Case No. 65/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar, Judicial Magistrate, 1st Class, Jamui subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
