ANJANA PRAKASH ORAL ORDER 12-02-2015 It appears that notices were issued to the Opposite Party no. 2 in the present case but none appears in his behalf. A report was also called for from the Court below as to the stage of the complaint. The Judicial Magistrate 1st Class, Patna reported that when the case was at the stage of Section 313 Cr. P.C on 22.01.2007, an application under Section 311 Cr. P.C. was filed by the prosecution which was dismissed on 26.07.2007 thereafter the matter has been pending for order on the criminal revision.
It has been submitted that no criminal revision was filed. Since the Magistrate has also not reported about any stay order having been passed by the revisional Court, I am surprised why the matter was kept pending for so many years at the stage of 313 Cr.P.C.
Patna High Court Cr.Misc. No.9755 of 2011 (14) dt.12-02-2015 2/2 Under Such circumstances, the application is disposed of with the direction to the trial Court to concluded the trial within 30 working days without granting unnecessary adjournment to any party.
