The petitioner is in custody in connection with Pirbahore P.S. Case No. 154 of 2013 registered for the offence punishable under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was not named in the FIR. Learned counsel for the petitioner further submits that nothing incriminating was recovered from the possession of the petitioner to implicate the petitioner in the instant case. Learned counsel would submit that petitioner is in custody since 19.12.2018.

Considering the aforesaid facts and circumstances including the fact that petitioner was not named in the instant case and nothing incriminating was recovered from the

Patna High Court CR. MISC. No.26664 of 2019(2) dt.23-04-2019 2/2 possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub Judge IX Cum ACJM, IX, Patna, in connection with Pirbahore P.S.
