JUSTICE RAKESH KUMAR ORAL ORDER 06-07-2017 Heard Mr. Zainul Abedin, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Dhanaha P.S. Case No.192 of 2016 registered for the offence under Sections 341, 323, 420, 504 and 506 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.

Learned counsel for the petitioner submits that the informant of the present case had himself taken huge amount from the petitioner and a false case was instituted, as if the petitioner had taken tractor with trolley of the informant and while he was demanding the same, he was abused and threatened. He submits that save and except false accusation, there is nothing on record.

Chief Judicial Magistrate, Bagaha, West Champaran in connection with Dhanaha P.S. Case No.192 of 2016, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
