The petitioners apprehend their arrest in connection with Chhatapur P.S. Case No. 132 of 2015 for the offences registered under Sections 341, 323, 324, 307, 427, 379 and 504/34 of the Indian Penal Code and Section 3(i) (x) of the SC/ST Act.
Learned counsel for the petitioner submits that provisions of Section 3 (i) (x) of the SC/ST Act have been levelled against the petitioners to make the charge graver. It is further submitted that though the allegation against the petitioners is that they had attacked the informant, yet the injury purported to have been inflicted upon the informant, has been found to be simple in nature. It is further submitted that the petitioners have no criminal antecedents.

No.31536 of 2016 (3) dt.08-09-2016 Considering the aforesaid facts and circumstances of the case and that the petitioners have no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Supaul in connection with Chhatapur P.S. Case No. 132 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
