The petitioners apprehend their arrest in Bansi P.S. case No. 25 of 2015 under Section 302, 201/34 of the Indian Penal Code.
The informant alleged that he married his daughter with Kanchan Yadav, son of the petitioners, in the year 2013 but after some time his son-in-law used to take wine and assault his daughter. On 25.04.2015 his daughter was killed and her dead body was thrown in river, Punpun. The informant further alleged that he has got belief that the accused persons killed his daughter and, in order to conceal the offence, thrown her dead body in the river.
It is submitted that petitioners are father-in-law and mother-in-law of the deceased. There is no specific allegation
Patna High Court Cr.Misc. No.30086 of 2016 (2) dt.08-09-2016 2/2 against the petitioners. The informant has made specific allegation that Kanchan Yadav, husband of the deceased, was assaulting his wife. The petitioners never tortured or assaulted the deceased. Similarly situated accused Awadhesh Yadav and others have already been granted anticipatory bail. The petitioners have no manner of concern with the Kanchan Yadav and his wife, who are living separately from the petitioners.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in Bansi P.S. Case No. 25 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
