JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2017 The appellants seek pre arrest bail in connection with Bihta P.S. Case No. 592 of 2016, registered for the offences punishable under sections 420, 465, 468, 341, 504, 506/34 of the Indian Penal Code and Section 3(1)(ix)(x) of the SC/ST (Prevention of Atrocities) Act.

Allegation against the appellant is that he along with others have abused the informant by taking caste name. Submission of learned counsel for the appellant is that for the same occurrence earlier a complaint petition was filed being Complaint Case No. 216 of 2016 and thereafter another case has been filed making same allegation.

Heard learned Special P.P. also.

Patna High Court CR. APP (SJ) No.1396 of 2017 (3) dt.18-07-2017 This appeal is not maintainable.

However, considering the submissions as made above, let the appellant surrender before the Special Court and make prayer for regular bail, and if any such application is filed, the learned Special Judge shall consider and pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court. With the above observation, this appeal is disposed of accordingly.
