JUSTICE SHIVAJI PANDEY ORAL ORDER 16-10-2020 Heard learned counsel for the petitioner and learned APP for the State through Virtual Court Proceeding. In this case, the petitioner is seeking regular bail in connection with Sessions Trial No. 351 of 2019, arising out of Sidhwalia P.S. Case No.91 of 2018, registered for the offence under Section 304(B)/34 of the Indian Penal Code and under Section 3/ 4 of the Dowry Prohibition Act.

The petitioner is the husband of the deceased. Allegation has been made that accused persons including this petitioner have killed the daughter of the informant on account of non-fulfillment of demand of dowry.

Earlier, the petitioner had moved before this Court for bail vide Criminal Miscellaneous No.74518 of 2018 and this

Patna High Court CR. MISC. No.22248 of 2020(4) dt.16-10-2020 2/2 Court vide order dated 22.02.2019 rejected the prayer of the petitioner for bail.

This Court vide order dated 24.08.2020 had called for the status report regarding stage of trial and per the report out of 10 witnesses 7 witnesses have been examined. In such view of the matter, this Court is not inclined to grant bail to the petitioner for the present. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to conclude the trial within a period of six months after restoration of normal Court proceeding. (Shivaji Pandey, J) pawan/- U T
