Perused the office note, from which it transpires that this appeal has stood dismissed for default as against the substituted heir of the deceased respondent no. 1. It further transpires from the memo of appeal that the plaintiffs are the appellants in the appeal against the judgment and decree of reversal . The deceased respondent no. 1 was one of the defendants in the suit and as such after dismissal of this appeal as against the substituted heir of the deceased respondent no. 1 proceeding further in this appeal may result in inconsistent orders or conflicting decrees.
