JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 12-07-2016 Heard the counsel for the petitioner and the State. The petitioner herein seeks anticipatory bail in Gogri P.S. Case No. 61 of 2016, registered under Section 363, 366(A) of the Indian Penal Code.

17 years old daughter of the informant was found traceless. A search was made in course whereof, the informant came to know that she had escaped along with accused persons named in the first information report. On retrieval, the statement of the girl was recorded by the learned Magistrate under Section 164 of Cr.P.C. (Annexure-3), in which she has not whispered anything about the petitioner. She has claimed herself as major. Considering the allegation which is based on suspicion and statement of the girl made under Section 164 of

Patna High Court Cr.Misc. No.25961 of 2016 (2) dt.12-07-2016 Cr.P.C, I am inclined to extend the privilege of anticipatory bail. Let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Gogri P.S. Case No. 61 of 2016 subject to the condition as laid down under Section 438(2), the code of Criminal Procedure with further condition that one of the bailors shall be his own/close family member. The petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
