JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 24-07-2025 Heard learned senior counsel appearing on behalf of the petitioner and learned A.P.P. for the State duly assisted by learned counsel for the informant.
2. Petitioner seeks bail in connection with Sahebpur Kamal P.S. Case No. 143 of 2024 registered for the offences under Sections 147, 341, 323, 307, 338, 326, 504, 506 & 302 of the Indian Penal Code and section 27 of the Arms Act.
3. The petitioner is named in the First Information Report and is in custody since 04.12.2025.
4. Allegation against the petitioner is to commit murder of husband of the informant along with other named co-accused persons over a petty issue regarding fixing of peg.

5. It is submitted by Mr. S.K. Lal, learned senior counsel appearing on behalf of the petitioner that specific allegation of firing is available against co-accused namely, Shivam Kumar and this petitioner was only caught hold the hand of deceased during occurrence. It is submitted that investigation of this case is already completed for which charge-sheet has been submitted and, as such, there is no chance of tampering with the evidence.

Learned A.P.P. for the State duly assisted by learned counsel for the informant, while opposing the prayer of bail of the petitioner, submitted that specific allegation of overt act is available against this petitioner as to caught hold of the hand of the deceased, who is none but the father of the co-accused namely, Shivam Kumar, who shot dead the husband of the informant. It is submitted that the informant is the eye witness of the alleged occurrence and neighbour of the petitioner.
7. In view of aforesaid factual submission and by taking note of the fact as the allegation of overt act as to caught hold of the hand of the deceased during the
Patna High Court CR. MISC. No.24906 of 2025(3) dt.24-07-2025 3/3 occurrence appears available against this petitioner, who is none but the father of the main co-accused, who shot dead the husband of the informant, accordingly, prayer of bail of the petitioner is hereby rejected.
9. Since the petitioner is in custody since 04.12.2024, learned trial court is directed to conclude the trial expeditiously preferably within a period of nine months. (Chandra Shekhar Jha, J) Rajeev/- U T
