ANJANA MISHRA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner being the Ex-Mukhiya apprehends her arrest in connection with a case registered for the offences punishable under Sections 409 of the Indian Penal Code.

Learned counsel for the petitioner submits that admittedly an enquiry was conducted in pursuance of a direction issued by this Court in a P.I.L., the Block Development Officer submitted a report holding one Shri Shyam Bihari Singh responsible for the irregularities in distribution of diesel in Gram Panchayat Akorha of which the petitioner was the Mukhiya. It is further submitted that though the petitioner was not indicted in the said report, but only on the basis of the some statements made by one Choudhary Charan Singh who is nothing but a local busy body, the

Patna High Court Cr.Misc. No.36173 of 2016 (3) dt.12-01-2017 P2/2 petitioner's name has been brought into in connection with the present irregularities committed in the Gram Panchayat Akorha. In view of the fact that the report do not indict the petitioner, let the petitioner abovenamed, in the event of her arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Vikramganj, Rohtas in connection with Dinara P.S. Case No. 49 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
