Petitioner seeks anticipatory bail in Sadar P.S. Case No.457 of 2017 instituted for the offence under Sections 457, 380, 411/34 of the I.P.C.

Allegation against the petitioner is of theft after entering into the house of the informant.

It has been submitted by the counsel for the petitioner that he has not been arrested on the spot. His name has surfaced on the basis of confessional statement of co-accused, Karan Rishi. He has no criminal antecedent. It has further been submitted that one similarly situated co-accused, Arvind Rishi has been extended the privilege of anticipatory bail by this Court vide order dated

Patna High Court Cr.Misc. No.2553 of 2018 (2) dt.17-02-2018 2/2 10.11.2017 passed in Cr.Misc. No.54074 of 2017 and the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Purnia, in Sadar P.S.Case No.457 of 2017 subject to the condition as laid down under Section 438(2) of Cr.P.C.
