The petitioners seek bail in Mokama P.S. Case No. 215/2017, instituted for offences under Section(s) 402, 406, 379, 323, 354 and 504 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that petitioner no. 1 is son and petitioner no. 2 is Samadhi of the informant.
It is alleged in the written report that informant is a widow lady. She had purchased a tractor. She had given the tractor to petitioners to run for monthly rental of Rs. 15,000/-. The petitioners gave Rs. 15,000/- to the informant for one year.
Patna High Court CR. MISC. No.23393 of 2019(2) dt.11-04-2019 2/2 Thereafter in month of October, 2016 petitioners took her tractor to Lakhisarai. They have neither paid the rent nor returned her tractor.
Learned counsel for the petitioners has submitted that it is a matter of family dispute. There is no any document to show that tractor was given by the complainant to the petitioners on rent.
Petitioners are in custody since 26.11.2018 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Barh, Patna, in connection with Mokama P.S. Case No. 215/2017, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
