2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 103(1), 352 and 3(5) of the BNS.
3. The case of the prosecution, in short, is that the petitioner along with others came to the house of the informant in her absence. It is further alleged that as the informant has gone to bring fodder, her daughter was being assaulted. As she returned, she saw that the petitioner along with others were strangulating the daughter of the informant with the help of scarf. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. He has falsely been implicated in present case. Learned counsel for the petitioner has submitted that from perusal of the FIR, it is clear that the occurrence is of 24.08.2025, the postmortem of the deceased was conducted on 25.08.2025, the application was filed on 26.08.2025 whereas the F.I.R. was lodged on 27.08.2025. It has further been submitted that this delay has given time to the informant for concocting a story. It has further been submitted that from perusal of the postmortem report, it will transpire as recorded by learned trial Court that the cause of death is asphyxia due to strangulation, pressure on neck and upper part of the chest.
It has further been submitted that in this case, altogether eight persons are named and it is alleged that all have strangulated her to death. It has further been submitted that the nature of allegation is general and omnibus. It has further been submitted that two similarly situated co-accused persons have been granted bail by this Court vide order dated 10.03.2026 passed in Cr. Misc. No. 13584 of 2026. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 13.01.2026.

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for bail. Learned counsel for the informant has submitted that learned counsel for the petitioner has not fairly submitted the facts of the case and that the deceased was brutally murdered.
6. Having heard learned counsel for the parties and considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dhanaha P.S. Case No. 271 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bagaha, West Champaran.
