The issue in the instant proceedings is an order of dismissal. The petitioner was dismissed from the services as a Constable in the Bihar Police in the district of Kishanganj. Learned counsel appearing for the petitioner submits that petitioner's appeal against the order of dismissal dated 09.03.2007 has not been disposed of by respondent No 5. Learned State Counsel, referring to Annexures brought on record by the petitioner in his supplementary affidavit, submits that it is apparent from the same that the

Patna High Court CWJC No.5032 of 2016(4) dt.07-11-2019 2/2 appeal of the petitioner has been rejected on 04.10.2016. The issue, however, remains that a copy of the order passed by the Appellate Authority has not been made available to the petitioner, even if the submission of the learned State Counsel is accepted. Learned counsel for the petitioner submits that if a copy of the order is made available, he would be in a position to assess the situation whether the same is to be assailed, or otherwise.

In view of the aforesaid situation, since no adjudication is required for the present, the writ petition is disposed of with a direction to respondent No 5 to serve a copy of the order passed on the petitioner's appeal to the petitioner. The petitioner should approach respondent No 5 along with a copy of this order within four weeks.

It is expected that respondent No 5 would make available a copy of the order expeditiously without any undue delay and preferably within four weeks thereafter. (Madhuresh Prasad, J) M.E.H./- U
