The petitioner seeks bail in connection with Amdabad P.S. Case No. 137 of 2019 for the offence under Sections 302, 201, 354(B)/34 of the Indian Penal Code and Section 8 of the POCSO Act.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 81511 of 2019 and the case of this petitioner stands on similar footing. The petitioner is rotting in judicial custody
Patna High Court CR. MISC. No.22281 of 2020(3) dt.21-10-2020 2/2 since 10.08.2019. Hence, the petitioner may be enlarged on regular bail.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Amdabad P.S. Case No. 137 of 2019, subject to the condition that both the bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case as well as the petitioner shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
