JUSTICE SATYAVRAT VERMA ORAL ORDER 10-01-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Falka P. S. Case No.30 of 2021, instituted for the offences under Sections 411, 413, 414, 420, 467, 468/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 04.02.2021, he has antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of two stolen motorcycle as detailed in the F.I.R. from the possession of the petitioner. The learned counsel for the petitioner submits that the petitioner had taken one motorcycle on hire from one Dev Narayan Mandal and thus, was not aware that the motorcycle

Patna High Court CR. MISC. No.35368 of 2021(2) dt.10-01-2022 2/2 was stolen one and the second motorcycle was not recovered from his possession.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 04.02.2021 and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Falka P. S. Case No.30 of 2021, subject to condition that one of the bailors shall be the father of the petitioner. The application stands allowed.
