This is an application for grant of anticipatory bail in connection with Ramnagar P.S. Case No. 108 of 2017 registered for the offence punishable under Sections 323, 341, 307 and 504/34 of the Indian Penal Code.
The case of the prosecution is that the petitioner and her husband had assaulted the informant and his mother on account of petty dispute resulting in simple injury on the person of the informant.
The learned counsel for the petitioner submits that the petitioner and her husband have been falsely implicated in the present case on account of petty dispute. It is further submitted that the allegation against the petitioner herein is general and
Patna High Court Cr.Misc. No.9826 of 2018(2) dt.19-02-2018 2/2 omnibus in nature i.e. regarding assault on the informant in the present case and the informant is said to have received simple injury. The petitioner is having a clean antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bagaha, West Champaran in connection with Ramnagar P.S. Case No. 108 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
