The petitioners apprehend their arrest in Jhajha P.S. Case No.30 of 2019 registered under Sections 272, 273, 34 of the Indian Penal Code and under Section 30(a)(d) of Bihar Prohibition and Excise Act.

The learned counsel for the petitioners submits that Jawa Mahua and small quantity of liquor made of Mahua are alleged to have been recovered from the house of the petitioners but from perusal of the seizure list, it would appear that seizure list is manufactured. Nothing was recovered from the house of the petitioner.

It appears from perusal of the F.I.R. itself that the

Patna High Court CR. MISC. No.24574 of 2019(2) dt.16-04-2019 2/2 informant got secret inputs about preparation of liquor of Mahua in the house of the petitioners and on such, raid was conducted. Liquor made of Mahua and Jawa Mahua were recovered from the house of the petitioners.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
