The learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application as against petitioner nos. 1 to 4.
Permission is accorded. The application is accordingly dismissed as withdrawn as against petitioner nos. 1 to 4.
Petitioner no. 5 apprehends his arrest for the offences alleged under Sections 147, 148, 149, 323, 324, 341, 307, 427, 379, 384, 504 and 506 of the Indian Penal Code, registered in
Patna High Court CR. MISC. No.25424 of 2022(2) dt.22-08-2022 2/2 connection with Nabinagar P.S.Case No. 53 of 2022. As per allegation, seven named accused persons including the petitioners attacked the informant and his family members. The allegation against petitioner no.5 is that he assaulted the informant and his driver with co-accused Chhotu Kumar Singh and Santosh Saw.
Learned counsel for the petitioners has submitted that after receipt of the CT scan report, the final opinion of the doctor has been obtained and injuries were found to be simple in nature.
Petitioner no.5 has two criminal antecedents. He is directed to surrender in the court below and seek regular bail. The application is accordingly rejected.
Office shall ensure that all the defects are removed by the petitioners within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
