Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Ekangar Sarai P.S. Case No. 82 of 2014 registered for the offences punishable under Sections 420/467/468/471/409/ 120(B) of the Indian Penal Code.

The allegation against the petitioner is of helping the widow of the deceased employee for family pension. The petitioner who was a clerk at the relevant time is said to have participated in the said offence.

It has been submitted by learned counsel for the

No.33944 of 2021(3) dt.21-03-2022 2/2 petitioner that the petitioner is a retired government servant aged about 73 years and the F.I.R. has been registered after seven years of retirement. He also submits that the entire case is based on documentary evidence and there is no chance of the petitioner absconding.

Considering the advance age of the petitioner and the fact that there is no chance of his absconding, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Ekangar Sarai P.S. Case No. 82 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
